Während der Warren-Court-Ära war er oft in der Minderheit, entwickelte sich jedoch zu einem Herzstück der Abstimmung am Burger Court. Stewart ging 1981 in den Ruhestand und wurde durch Sandra Day O'Connor ersetzt.
